In a February 24, 2014 notice in the Federal Register, the Department of Health and Human Services announced a pre-audit investigation HIPAA covered entities and business associates. The information collected will include a survey to 1,0 associates and covered entities to determine fitness for office of civil rights of the audit program (OCR) HIPAA. The survey will collect information on the size, complexity, the number of patient visits, revenue, and places of business of health care providers. This second series of HIPAA audits, monitoring of the OCR pilot audit program established in 2012, is based on the mandate OCR conduct periodic audits to assess compliance with HIPAA security rules and breach notification.
for covered entities and associates who have been less diligent in meeting their HIPAA compliance requirements, this opinion is but another reminder that OCR continues to intensify its proactive enforcement efforts to identify and take measures against non-compliant entities.
